Transfer of rights to parental leave or parental allowance due to illness, accident or imprisonment

A parent who is unable to care for their child in the first 24 months following the birth of the child due to an illness, an accident, or an imprisonment, may transfer their unused right to parental leave or allowance to the other parent in part or in full.

The same applies when a child enters the home at the time of initial adoption or permanent foster care, which is based on the first 24 months after the child's arrival.

This applies whether or not the parents share custody over the child or not.

When a parent is unable to give their consent due to an illness or the consequences of an accident, the Directorate of Labour shall assess whether the conditions for a transfer of rights are met.

The medical condition of the parent which leads to them being unable to care for the child or to give consent to the transfer of their rights shall be confirmed by a medical certificate.

Confirmation from the Prison and Probation Administration must be obtained if the parent is to serve a prison term.
