  • The surviving spouse may demand the change of the estate at any time. He or she needs the approval of other heirs to divide the estate by private settlement, but can always demand that the estate be publicly divided before a district court.

  • If an heir (a stepchild) was not financially competent at the time of issue of the licence, he/she may claim for his/her heirs' income within three months of reaching the age of 18.

  • If an heir (a stepchild) has given his consent to the licence, he/she may claim for his/her heirship one year in advance.

  • If an heir proves that the surviving spouse has impaired the substance of the estate by unsuitable financial management or provides reason to fear such a deterioration.

  • If a spouse has made an unreasonably large donation in relation to the substance of the estate, the heir may demand that the gift be rescinded by judgment within certain time limits in the case of the estate's exchange.

  • If an heir who owns a share in an unallocated estate dies, his heirs shall have the same right as he would have had to demand the division of the estate.
