Request for a ruling on child support

A party who is responsible for the expenses of supporting a child may demand that the District Commissioner decide on child support payments from the other parent.

Conditions

To request child support payment, you must

  • exercise custody of a child, or

  • have the legal domicile of the child registered with you

Process

The District Commissioner shall receive the request.

The District Commissioner shall introduce the request to the parent to whom it is directed and give the parent an opportunity to express himself or her views and provide evidence in the case. As appropriate, the applicant may also comment on this pleading.

When the case is sufficiently cleared, the District Commissioner shall deliver a reasoned ruling in the case.

Refundable payments

If the child or children are being claimed for child support for the first time, such claims will generally not be recognized more than one year after the claim was made.

If the requirement involves a change back in the previous maintenance determination, then there must be exceptional circumstances in which to comply with such a requirement.

Complaint period

The ruling of the District Commissioner may be appealed to the Ministry within two months of the date of the ruling.
